- Travel Japan GenAI Chatbot

The following terms (these “Terms”) are a binding legal agreement between Japan National Tourism Organization (“JNTO”, “we”, or “us”) and you regarding your use of the Travel Japan GenAI Chatbot (the “Travel Chatbot”). Please read these Terms carefully before using the Travel Chatbot. By clicking “I agree to these Terms of Use” when using the Travel Chatbot, you indicate your acceptance of and agreement to all Terms. If you do not agree to these Terms, please do not use the Travel Chatbot. 

 

 

Using the Travel Chatbot 

 

Subject to your compliance with these Terms, you may access and use the Travel Chatbot. In using the Travel Chatbot, you must comply with all applicable laws, as well as any documentation, guidelines, or policies we make available to you. 

The Travel Chatbot is a chatbot designed for providing travel information on Japan to tourists from outside of Japan. 

 

Use of Input.  We store information and text that you provide to the Travel Chatbot (the “Input”) and use the Input as marketing data. 

 

Third-Party Websites.  The Travel Chatbot may refer you to third-party websites, such as by providing you with URLs of third-party websites. You are solely responsible for visiting such third-party websites and JNTO does not guarantee the accuracy of any information provided therein. 

 

Sharing with Third Parties.  You may share responses generated by the Travel Chatbot with third parties; provided that you must obtain such third parties’ written consent that JNTO and its service providers are not responsible for the contents of the responses. You are solely responsible for verifying the accuracy of the responses before sharing them with any third parties. 

 

Limitations 

 

Accuracy.  While JNTO and its service providers are constantly working to improve the Travel Chatbot to make it more accurate and reliable, due to the current nature of artificial intelligence and machine learning, responses generated by the Travel Chatbot may not be accurate, up-to-date, comprehensive, or beneficial. You acknowledge and agree that you are solely responsible for verifying the accuracy of any information you receive from the Travel Chatbot and for acting appropriately based on that information. 

 

Disaster Information.  Based on your query to the Travel Chatbot, the Travel Chatbot may provide you with disaster information (e.g., information relating to an earthquake just takes place, etc.). However, due to the current nature of artificial intelligence and machine learning, such information may not be accurate or up-to-date. Accordingly, you should confirm the original source of any such information.  

 

Language and Translation.  The original language of these Terms and provisions of the Travel Chatbot is English (text translated into other languages is for reference purposes only). The Travel Chatbot may provide information translated from languages other than English. As such translations are generated independently (i.e., with no human oversight), you acknowledge and agree that (i) the translation may not be accurate, and (ii) some portions of the original text may be omitted from the translation. Further, you acknowledge and agree that the translation function of the Travel Chatbot may not be used under certain conditions, and that third-party websites to which the Travel Chatbot refers you may not have a translation function (i.e., languages other than English may be displayed on such third-party websites). 

 

Functional Limitations.  The Travel Chatbot is designed for providing travel information on Japan to tourists from outside of Japan. As such, the Travel Chatbot may be unable to provide adequate responses to a query that you input, and may refuse to respond to queries that are inappropriate or unrelated to travel to/in Japan. 

 

No Personal Information.  You shall not provide any information that, either by itself or in combination with other information that may be referenceable, lead to the identification of a person (“Personal Information”). You acknowledge and agree that we may delete any Personal Information provided to the Travel Chatbot. 

 

Restrictions 

 

You may not conduct the following activities in connection with your use of the Travel Chatbot: 

 

• Use the Travel Chatbot for illegal, harmful, or unfair activities, or use the Travel Chatbot for fraudulent purposes; 
• Provide false information or make obscene expressions to the Travel Chatbot; 
• Use the Travel Chatbot in a way that infringes, misappropriates, or violates the rights of third parties (including intellectual property rights, right of privacy, right of dignity), or is likely to infringe, misappropriate, or violate such rights; 
• Interfere with or disrupt the Travel Chatbot, or conduct activities that are likely to interfere with or disrupt the Travel Chatbot; and 
• Attempt to reverse engineer, decompile, or discover the source code or underlying components of the Travel Chatbot, or assist anyone else with doing so, including with respect to the models, algorithms, and/or systems (except to the extent that this restriction is prohibited by applicable law). 

 

Disclaimer of Warranties  

 

THE TRAVEL CHATBOT IS PROVIDED “AS IS.” EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, JNTO AND ITS SERVICE PROVIDERS MAKE NO WARRANTIES (EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE) WITH RESPECT TO THE TRAVEL CHATBOT, AND DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, NON-INFRINGEMENT, AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING OUT OF ANY COURSE OF DEALING OR TRADE USAGE. JNTO DOES NOT WARRANT THAT THE TRAVEL CHATBOT WILL BE UNINTERRUPTED, ACCURATE, OR ERROR-FREE, OR THAT ANY INFORMATION PROVIDED TO IT WILL BE SECURE OR NOT LOST OR ALTERED. 

 

YOU ACKNOWLEDGE AND AGREE THAT ANY USE OF INFORMATION PROVIDED BY THE TRAVEL CHATBOT IS AT YOUR SOLE RISK AND YOU WILL NOT RELY ON THE INFORMATION AS A SOLE SOURCE OF TRUTH OR FACTUAL INFORMATION. 

 

Limitation of Liability  

 

NEITHER JNTO NOR ITS SERVICE PROVIDERS WILL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOST PROFITS, GOODWILL, USE, OR DATA, OR OTHER LOSSES, EVEN IF JNTO OR ITS SERVICE PROVIDERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE LIMITATIONS IN THIS SECTION APPLY TO THE EXTENT PERMITTED BY APPLICABLE LAW. 

 

Some countries and states may not allow certain warranties or limitations on certain damages. Accordingly, some or all of these Terms may not apply to you, and you may have additional rights beyond those set forth herein. In such case, these Terms only limit our responsibilities to the maximum extent permissible in your country of residence. 

 

Indemnity

 

To the extent permitted by applicable law, you will indemnify JNTO and its officers, personnel, and service providers related to the Travel Chatbot from and against any and all costs, losses, liabilities, and expenses (including attorneys’ fees) from third-party claims arising out of or in connection with your use of the Travel Chatbot or any violation of these Terms. 

 

Governing Law

 

These Terms are construed under and governed by the laws of Japan without regard to its conflict of law principles. 

 

Dispute Resolution

 

You acknowledge and agree that any disputes between JNTO and you arising out of or in connection with these Terms and/or your use of the Travel Chatbot shall be exclusively brought before the Tokyo District Court as the court of first instance. 

 

General Terms 

 

Assignment.  You may not assign or transfer any rights or obligations under these Terms, and any attempt to do so will be void. 

 

Entire agreement.  These Terms constitute the entire agreement between you and JNTO regarding the Travel Chatbot and supersede any prior or contemporaneous agreements between you and JNTO.
