JNTO London Terms and Conditions
1. The Promotor
The promoter is Japan National Tourism Organisation London office, 1st Floor, 125 Kensington High Street, London W8 5SF (the ‘Promotor’, ‘we’, ‘us’ and ‘our’).
2. These Terms
2.1 These Terms and Conditions (‘Terms’) apply to any prize draw or promotion which we may run whether on our website, social media platform or otherwise (‘Promotion’).
2.2 From time to time we may issue additional terms that apply to specific Promotions (‘Promotion Specific Terms’). The Promotion Specific Terms will be made available here.
2.3 In the event of any conflict or inconsistency with any between these Terms and any Promotion Specific Terms, the Promotion Specific Terms shall prevail.
2.4 By entering a Promotion, you agree to be bound by these Terms together with any Promotion Specific Terms we may issue in relation to a Promotion you enter. Please retain copies for your information.
3. The promotion
3.1 The title of the Promotion and details about how to enter are as set out in the Promotion Specific Terms.
3.2 All entries must be received by the closing date set out in the Promotion Specific Terms.
3.3 The Promotion is free to enter and no purchase is necessary.
4. How to enter
4.1 Only one entry per person is allowed for each Promotion unless otherwise stated in the Promotion Specific Terms. All additional entries will be disqualified.
4.2 No third party or bulk entries. If, in the view of the Promotor, a participant or household is using any means to circumvent this condition such as, and without limitation, multiple email accounts, multiple reproduced or computer-generated entries, using multiple identities, fraudulently falsifying data, acting fraudulently or dishonestly in the opinion of the promoter or otherwise acting in violation of these terms, these entries will be not be valid and the Promotor reserves the right to disqualify such entries. In this case, no prize will be provided.
4.3 The Promotor reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the Promotion.
4.4 Incomplete, illegible, misdirected or late entries will not be accepted. Proof of sending will not be accepted as proof of delivery or receipt. No responsibility can be accepted for entries that are incomplete, lost due to technical reasons, corrupted, delayed, wrongly delivered, not received for any reason, or where you are not automatically added to the list of participants.
5. The prize
5.1 Please see the Promotion Specific Terms for the available prizes.
5.2 The prize for the winner is non-exchangeable, non-transferable and no cash alternative is offered.
5.3 The Promotor will endeavour to dispatch the prize to the winner within 14 days of being notified of their win. However, the Promotor will not be responsible for any delays in dispatching the prizes.
5.4 The Promoter reserves the right to substitute a prize of equal or greater value should circumstances outside its control make this necessary.
6. Winners and claiming the prize
6.1 Winner(s) will be randomly selected by a computerised random generator from all entries unless a different selection method is set out in the Service Specific Terms.
6.2 The winners will be notified by email via the account provided at point of entry within 14 days of the closing date and will have 14 days from notification to claim their prize. If a winner does not claim their prize within this timeframe the Promoter reserves the right to withdraw prize entitlement and will award the prize to a reserve drawn at the same time as the original or, alternatively, the Promotor is entitled to select another winner in accordance with the process set out above.
6.3 It is your responsibility to provide correct, up-to-date details when entering the Promotion and when accepting the prize. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.
7. Eligibility
7.1 The Promotion is open to UK residents (England, Scotland, Wales and Northern Ireland) aged 18 years or over, excluding:
(a) employees of the Promoter or other JNTO offices;
(b) employees of agents or suppliers of the Promotor or other JNTO offices, who are professionally connected with the Promotion or its administration; or
(c) members of the immediate families or households of (a) or (b).
7.2 To be eligible to enter a Promotion you must be an active subscriber to the Promoter’s newsletter on the closing date of the Promotion,
7.3 In entering the Promotion, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promotor may require you to provide proof that you are eligible to enter the Promotion.
8. Data protection and publicity
Any personal information that you share with the Promoter will be kept secure and used in accordance with the Promoter’s privacy notice which is available here.
9. Limitation of liability
Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
10. General
10.1 The Promoter’s decision is final and binding. No correspondence will be entered into.
10.2 The Promoter reserves the right to hold void, cancel, suspend, or amend the Promotion where it becomes necessary to do so.
10.3 By entering the Promotion, each entrant grants the Promoter a world-wide, perpetual, irrevocable, non-terminable, non-exclusive, transferable, royalty free and sub-licensable right and licence to use reproduce, modify, adapt, publish or display (in whole or in part) any intellectual property contained in the content of their entry, without royalty, payment or other compensation. Each Entrant agrees not to assert any moral rights in relation to such use and warrants that they have full authority to grant such rights.
10.4 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname and county of major prize winners and, if applicable copies of their winning entries, to anyone who emails enews_uk@jnto.go.jp or writes to the address set out in condition 1 above (enclosing a self-addressed envelope) within one month after the closing date as set out in the Service Specific Terms. If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter at enews_uk@jnto.go.jp. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
10.5 The Promoter reserves the right, at its sole discretion, to eliminate or disqualify any entries or entrants that it regards as being in breach of these Terms or the spirit of the Promotion. Those who try to circumvent the entry process and/or entry instructions by any method, will be disqualified and any prize award will be void.
10.6 The Promoter accepts no responsibility for system errors or other issues that may result in disruption to, lost, delayed or not received entries, winner notifications or prizes. The Promoter will not be responsible for the non-inclusion of entries as a result of technical failures or otherwise, including any such failure which is within the control of The Promoter or its agencies.
10.7 If any of these clauses (or part of) should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and the remaining clauses (or part of) shall survive and remain in full force and effect.
10.8 The Promoter reserves the right to cancel, amend, withdraw, terminate or temporarily suspend this promotion in the event of any unforeseen circumstances or technical reason outside its reasonable control, with no liability to any entrants or third parties but will use all reasonable endeavours to avoid consumer disappointment.
10.9 The prize draw will be governed by English law and entrants to the prize draw submit to the jurisdiction of the English courts.
